Gasoline Dispensing Facility

A gasoline dispensing facility (GDF) is a facility that stores and/or dispenses gasoline. Gasoline is any petroleum distillate having a Reid vapor pressure of 4 pounds per square inch or greater. Vapor pressures may be obtained from standard reference texts or may be determined by ASTM D-2879-83 or ASTM D-323-82.

What Needs a Permit?

Any facility or contrivance dispensing gasoline from storage tanks having a capacity of 250 gallons or more.

Permit Fees

New GDFs:

Every applicant for an Authority to Construct a new GDF shall pay the general permit application fees specified in Rule 301.

Modification of Existing GDFs:

  • When an application is filed for a modification of an existing GDF the permit fees specified in the general permit fee determination sheet.

Change of Location or Ownership of Existing GDFs:

When an application is filed for a permit because the ownership of a GDF has been transferred from one person to another, the applicant shall pay a permit fee in accordance to Schedule 2 in Rule 301.

Annual Renewal Fees:

Gas stations with a throughput less than 600,000 gallons per year are exempt from requirements to install In-Station Diagnostics.  These stations will be assessed a fee which represents throughput of less than 600,000 gallons per year based on the number of nozzles.  If the number of nozzles is greater than 3 but throughput is less than 600,000, the throughput category of 3 nozzles shall be used. 

Expected throughput for gasoline dispensing facilities shall be based on the number of nozzles as shown in Table 1 of Rule 301.

Owners of gasoline dispensing facilities may request a different throughput category than would be estimated based on the number of nozzles for Monterey Bay Air Resources District (MBARD) approval on a case-by-case basis.  Any restriction on throughputs shall be enforceable by the MBARD permit.

Permit Application Completeness Determination

An application will not be accepted for processing until it is deemed complete.  The following will be required in order for MBARD to make a completness determination:

  • Completed Form 1 ATC-PTO Gasoline Dispensing Facility Application with the original signature of the owner/proprietor or responsible officer of the company.
  • Submittal of fees outlined in Form 400- General Application Fee Determination Sheet and in accordance with District Rule 301.
  • Any additional information that may be requested in order to perform a health risk assessment or to better understand the process or the applicability of regulations.
