10/7/26 - 30-DAY PUBLIC NOTICE OF INTENT TO ISSUE AN AUTHORITY TO CONSTRUCT PURSUANT TO CALIFORNIA HEALTH & SAFETY CODE §42301.6
California Health & Safety Code Section 42301.6 requires the Monterey Bay Air Resources District (MBARD) to notify parents or guardians of children attending any kindergarten through grade 12 school located within one-quarter mile of a proposed source of toxic air emissions, as well as all addresses within a 1,000-foot radius of the proposed source, before approving a permit to construct such equipment.
This notice is to inform you that MBARD received an application from SJB Development, LP dba The Alameda, to install and operate a retail gasoline and E85 fuel dispensing facility at 404 The Alameda, San Juan Bautista, CA, 95045.
The proposed facility will store and dispense gasoline and E85 fuel for motor vehicles. Gasoline and E85 contain volatile organic compounds (VOC) that evaporate into the air. Operation of the fueling equipment will also emit small quantities of toxic air contaminants, mainly benzene. This notice is being provided because the project will be located within 1,000 feet of the outer boundary of San Juan Elementary School.
MBARD evaluated the permit application for the proposed project and has made a preliminary determination that the project will comply with all applicable air district, state and federal air quality-related regulations, including the health risks resulting from toxic air contaminant emissions. The preliminary recommendation is to issue an Authority to Construct.
There is a 30-day period for public review of this proposal. Anyone wishing to comment on the proposed issuance of this permit should submit their comments in writing by November 6th, 2026 to the following address:
Monterey Bay Air Resources District
Attn: Fernando Pena
24580 Silver Cloud Court
Monterey, CA 93940
All comments received during this 30-day period will be reviewed and considered by MBARD staff before a final decision is made on this application.
